Terms of Service
Terms of Service
Last updated: May 2026. These terms govern your use of petekpastry.com and your purchase of products from Petek Pastry USA. By placing an order, you agree to these terms. Please read them carefully and contact us at [email protected] with any questions.
1. Who we are
Petek Pastry USA (“we”, “us”, “Petek Pastry”) sells handmade Turkish baklava, pastries, and related products through petekpastry.com to customers in the United States and nearby shipping zones.
2. Orders, prices, and payment
All prices on the site are in U.S. dollars and exclude applicable taxes and shipping costs. Final pricing, tax, and shipping are calculated at checkout. We accept the payment methods displayed at checkout (currently WooCommerce Payments, PayPal, and Shopier). We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, payment failure, pricing errors, or product unavailability. If we cancel a paid order, you will receive a full refund to your original payment method.
3. Ingredients and allergens
Our products contain or may contain: tree nuts (pistachio, walnut, almond, hazelnut), dairy (butter, milk), wheat (gluten), and eggs. All products are prepared in a shared kitchen that handles nuts, dairy, gluten, and other allergens. We cannot guarantee that any product is free from any specific allergen even if not listed as an ingredient. If you have a severe food allergy, please do not order. By placing an order you acknowledge this risk.
Individual product ingredient lists are shown on each product page. We recommend reviewing the product page carefully before ordering, especially if you or the recipient has dietary restrictions.
4. Freshness, storage, and shelf life
Our baklava and pastries are made to order and shipped within 1–3 business days of order placement. For best quality, products should be consumed within 10 days of delivery when stored at room temperature in their original sealed container, or up to 30 days when refrigerated, or up to 3 months when frozen. Specific storage guidance is included with each shipment and on individual product pages where applicable.
5. Shipping
We currently ship to addresses within the United States. Shipping methods, rates, and estimated delivery windows are displayed at checkout. Most orders are shipped via insulated packaging with ice packs (where seasonal conditions require) to preserve product quality in transit.
Delivery delays: We are not responsible for shipping carrier delays caused by weather, holidays, incorrect addresses provided at checkout, or carrier operational issues. Once a package has been handed to the carrier, delivery time is controlled by the carrier. We will assist where possible with tracking and carrier-side claims.
Temperature damage: While we package every order with care, summer-month transit can occasionally affect product texture (softening, melting of toppings). This does not constitute a defective product unless the contents are inedible. If your product arrives in a condition you consider unacceptable, please contact us within 48 hours of delivery with photos, and we will evaluate replacement or refund on a case-by-case basis.
6. Returns and refunds
Because our products are perishable food items, we do not accept returns. If your order arrives damaged, defective, or incorrect, please contact us at [email protected] within 48 hours of delivery with your order number and photographs of the issue. We will make it right via replacement, partial refund, or full refund at our discretion.
We do not refund orders for the following: customer-side delivery refusal, undeliverable addresses, requests for refund after the freshness window has lapsed, or claims made more than 48 hours after delivery.
7. Wholesale orders
Wholesale accounts are subject to additional terms including minimum order quantities, lead times, payment terms, and resale agreements communicated at account approval. To apply for a wholesale account, visit our wholesale signup page.
8. Limitation of liability
To the maximum extent permitted by law, Petek Pastry USA’s total liability arising out of or related to any order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special, or consequential damages, including lost profits, even if advised of the possibility of such damages.
9. Intellectual property
All content on this site — including logos, photographs, product descriptions, and the Petek Pastry name — is owned by Petek Pastry USA or licensed to us. You may not reproduce or use this content for commercial purposes without our written permission.
10. Governing law
These terms are governed by the laws of the State of [STATE TO BE FILLED IN BY OWNER], without regard to its conflict of law principles. Any disputes will be resolved exclusively in the courts of that state.
11. Changes to these terms
We may update these terms at any time. The updated version takes effect when posted on this page. Continued use of the site after changes constitutes acceptance of the new terms.
